SUPREME COURT ENCOURAGES PHONY PLAINTIFFS AT SAME TIME IT WEIGHS UPENDING STANDING, UNDERCUTTING ADA

(October 4, 2023) – Today, the Supreme Court will hear arguments in Acheson Hotels v. Laufer, a case that will determine not only whether a hotel’s failure to post accessibility information about its facilities online violates the Americans with Disabilities Act (ADA) — but also whether people whose civil rights are violated are allowed to bring “tester” cases like this before the court in the future.


“It’s never been easier for phony, lab-grown right-wing plaintiffs to get pet issues in front of the Supreme Court. But when a landmark civil rights law is at odds with corporate profits they’re suddenly very concerned about standing? Give me a break,” said Sarah Lipton-Lubet, president of Take Back the Court. “The fact that they’re even hearing this case today is more evidence of a right-wing Court majority drunk on power. They have no consistency and no guiding principle other than their desire to unilaterally rewrite any law that conflicts with their regressive agenda.”
